Brandon Township Public Hearing Meeting Minutes

April 17, 2017

 

The Public Hearing for residents included in the Big Chip Area 2017 Paving Project was held on April 17, 2017, at the Brandon Community Center with Supervisor Gene Fynboh, Supervisor Kerby Lund, Supervisor Dennis Lund, Treasurer Kathy Zimmerman and Clerk Mike Cleary present.  With a quorum present, the meeting was called to order at 6:30 pm. The pledge of allegiance was recited. 

 

Clerk Cleary noted that all residents had been mailed a notice of the meeting together with minutes from the September 17, 2016 Public Hearing and updated cost and assessment information.  He further stated that this mailing was delivered to the post office on April 3, 2017 and that the Public Hearing Notices had been published in the Apri7 and April 14, 2017 issues of The West Douglas County Record.

 

Supervisor Fynboh stated that the purpose of the meeting was to update the residents on the status of the paving project and to listen to any new concerns and questions.  There were approximately 23 residents in attendance.

 

Clerk Cleary reported receiving 3 phone calls with 2 supporting the project and 1 opposed. 

 

A letter was the read from Jim Adam that had been delivered immediately before the hearing.  Jim questioned the assessment to his Outlot as not being buildable. It was noted that he had received a waiver from the County Commissioners allowing the construction of a storage building with the restriction that it not be used as a residence. 

 

Ellen and Mary Roers questioned why the pavement on the north end of the project had to include their parcel.  It was explained that the payment was extended to the township line at the top of the hill past their lot as being the logical ending point to prevent erosion on the hill.

 

All of the concerns raised by the residents will be considered as the project moves forward. 

 

On a motion by K Lund and a second by D Lund, the attached Resolution No. 04-17-2017 was adopted unanimously.

 

Chair Fynboh thanked everyone for coming and adjourned the Public Hearing at 7:00 pm.

RESOLUTION NO. 04-17-17

 

A RESOLUTION ORDERING THE BIG CHIP AREA 2017 PAVING PROJECT AND THE PREPARATION OF PLANS AND TAKING OTHER ACTIONS RELATED THERETO

 

 

WHEREAS, the Town Board of Brandon Township, Minnesota (the “Town”) has taken action to undertake certain improvements to the roadway of Hedeen Road from County Road 58 to Eagle Point Drive to Big Chip Road and to the roadway of Big Chip Road including spurs and Eagle Point Drive in the Town, including aggregate shoulder, aggregate base, bituminous, and sealcoating (the “Big Chip Area 2017 Paving Project”), in accordance with the terms of Minnesota Statutes, Chapter 429, as amended; and

 

WHEREAS, Jeff Stabnow, engineer for the Town, has prepared a feasibility study for the Big Chip Area 2017 Paving Project (the “Feasibility Study”); and

 

WHEREAS, ten day’s mailed notice and two weeks’ published notice of the hearing was given, and the hearing was held on such improvements on the date hereof, at which all persons desiring to be heard were given an opportunity to be heard thereon.

 

NOW, THEREFORE, BE IT RESOLVED BY THE TOWN BOARD OF BRANDON TOWNSHIP, MINNESOTA, AS FOLLOWS:

 

1.         Such improvements are necessary, cost effective, and feasible as detailed in the Feasibility Study, and such improvements are hereby ordered.

 

2.         The Town Board hereby ratifies all previous action taken by the Town Board with respect to the Big Chip Area 2017 Paving Project.

 

3.         Jeff Stabnow is hereby designated as the engineer for this improvement.  The engineer shall prepare plans and specifications for the making of such improvements.

 

4.         The Town Board declares its official intent to reimburse itself for the costs of the improvements from the proceeds of tax-exempt bonds.

 

Adopted by the Town Board of Brandon Township, Minnesota this 17th day of April, 2017.
