Monday, May 21, 2012
The May monthly meeting was called to order by Cleary at 7:00 p.m. The pledge of allegiance was recited.
Clerks Report: The minutes of the April 16, 2012, meeting were addressed. The reading of the minutes were waved and then approved on a motion by Fynboh, seconded by Lauthen, and carried.
Treasurer’s Report: Beginning balance on 04/01/2012 was $24,001.04. Interest from Revenue on account at Bremer was $.62. Other income was $0. Orders issued were $1,617.84 for a total ending balance of $22,383.82. Investments reported included Tar & Road Fund received $15.96 in interest, to now total $197.487.79. Motion made by Lauthen, seconded by Fynboh, and carried, to approve report.
Public Comment: Three visitors were present to address issues on the agenda.
Agenda Approval: The agenda was adjusted to have all items of interest to the visitors addressed first, then approved with additional items, on a motion by Lauthen, seconded by Cleary and approved.
a. Maxine and Ralph Crooker are seeking clarification about Burros Lane. Trees have been removed, road has been widened and gravel will be put on the road. Upon further discussion, the supervisors will inspect the area at 8 a. m. on Tuesday morning. Crookers plan on submitting a petition to vacate the west end of Burros Ln. which abuts their lot.
b. Chris Arndt raised a question about the CRLSD tax on some of their properties. Clerk will check out map of the sewer district and get back to Arndt's.
a. Edgefield cemetery: Lauthen reported that Buse will again mow the cemetery.
b. Milbrandt Road vacation: Resolution 05-21-2012 was submitted for the vacation of Milbrandt Road in section 23 of Brandon Township. No resident was present to speak in favor or against the resolution. On a motion by Fynboh, seconded by Cleary, and carried with a unanimous vote, the resolution was passed (cf. Resolution below) Clerk Ledermann will take the resolution to the Douglas County Recorder and Public Works.
c. Stramer petition to vacate Severson Rd: On May 15, the clerk received a petition signed by eight residents to seek vacation of a small part of Severson Rd that has never been developed and lays in lot 1 of the Forttee Addition in section 7 of Brandon Township. On a motion by Cleary, seconded by Fynboh, and carried, the petition was accepted and the next monthly meeting on June 18, 2012 was set as the date for a public hearing on a resolution to vacate that part of Severson Rd.
d. Big Chip Road culvert installation has been completed and the bill has been received from Bitzan Backhoe. The Board also received a request to address some water ponding near the Gilson property on Big Chip Road.
e. Excel energy use of town roads: The board reviewed the maps and see no problem with the intended use of township roads to build the power line. The clerk will notify Moe township that they are not interested in joining other townships to retain legal counsel regarding any possible need to repair roads.
f. Road report: Graveling is proceeding, Chloride is to be spread this week; clerk has prepared addresses for truck riders; trees have been removed, although more tree removal is needed on Tanglewood Rd; Cleary to contact Klimek. Two quotes were received for repair of Shorewood Lane Road. On a motion by Cleary, seconded by Lauthen and carried, a contract with Riley Bros for the sum of $8,658.00 was accepted. Fynboh will contact them and the clerk will send them the accepted quote. Three inches of existing broken bituminous will be removed; 9” of class 5 and 4” of bituminous surface will be laid on.
g. Election Judges: Diane Smith was appointed head judge for the August primary on a motion by Cleary, seconded by Lauthen and carried. She will contact recruit judges and notify them of election training dates.
h. Ballot information: Clerk will forward info about two supervisor positions and the treasurer's position for the November ballot to Vicki Doehling. Also on the ballot will be a resolution to appoint rather than elect the clerk and treasurer.
Land Use Permits: One new permit was received.
MATIT comprehensive Insurance renewal packet was received and viewed.
Lund temporary building permit has been addressed by Croonquist as the board had no problems with the request.
Clerk notes included LTAP info, Land stewardship report on vote to maintain local control, invites to County Road meeting, and AAEDC luncheon. Cleary also noted a public meeting on May 23 in Brandon to discuss the support for AAEDC through tax assessment.
Claims and Wages: Claims and wages requests were presented and viewed by the board. Claims included: Douglas County Assessor-$7,238.00 for assessing; The Record-$4.510 for public notice; Hilltop Lumber-$982.70 for culverts; MATIT-$1,996.00 for insurance; West Central Petroleum-$1,929.20 for diesel; Otter Tail Power-$21.01 for shop electricity; Klimek's Tree Service-$1,980.00 for tree removal; Bitzan Backhoe Service-#610.00 for culvert and road repair; Pro Ag Farmers Coop-$1,187.20 for bulk oil. Claims and wages were ordered paid on a motion by Lauthen, seconded by Fynboh, and carried.

Brandon Township Road Order
State of Minnesota, County of Douglas, Town of Brandon
Whereas, Upon the petition of 8 legal voters who own real estate or who occupy real estate within three (3) miles of the road proposed in said petition to be vacated; which said petition was filed with the Town Clerk on March 19, 2012, who presented it the Brandon Town supervisors for action, and which said road (named Milbrandt Road) is set forth and described as follows: Beginning at County Road 58 in Section Twenty Three (23), Twp 129, Range 39, of Brandon Township, and ending six tenths of a mile (.6) south still in section 23 and there terminate, the entire length of Milbrandt Road is to be vacated.
And Whereas: Upon receiving the said petition at the Brandon Community Center on March 19, 2012, the supervisors set May 21 at the Brandon Community Center as the time and place to act upon the petition and ordered the town clerk to post public notice and send notice to the residents of land affected by the vacation of Milbrandt Road.
Be it Resolved: That the entire length of Milbrandt Road in Section twenty three (23), Brandon Township (129), Range thirty nine (39) be vacated.
