 Brandon Township Meeting Minutes  (official)April 18, 2011 The regular monthly meeting of the Brandon Township Board was held on Monday, April 18, 2011 at the Brandon Community Center with Paul Lauthen, Michael Cleary, Jennifer Lanners, Diane Smith and Adrian Ledermann present. The meeting was called to order by Mike Cleary at 7:00 p.m.  The pledge of allegiance was recited. Clerks Report:  The minutes of the March 21st meeting were addressed.   The minutes were approved with one spelling correction on a motion by Lanners, seconded by Cleary and carried. Treasurer’s Report:  Beginning balance on 03/01/2011 was $35,143.10.   Interest from Revenue on account at Bremer was $1.24.  Orders issued were $4,988.54 for a total ending balance of $30,155.80.  Investments reported included Tar & Road Fund received $79.07 in interest to now total $206,977.85.   Motion made by Lanners, seconded by Lauthen, to approve report; carried.   Public Comment: No public comment Agenda Approval:  The revised agenda was approved with no additional items. Old Business:  a. Road sign update: Lanners reported that the MN Township short course reinforced previous info; several bulk pricing officers were received; board seeks to get action plan in place in the next few month; Lanners will pull proposals together.  Cleary reported liability issues are now a focus of concern.b. Road update: Chippewa Hts road is breaking up.  Board will inspect on Tuesday morning.c. Glass has been replaced in grader.  Clerk will submit insurance bill.d. Slack Road:  Lauthen and Robley inspected new construction; does not meet specs.  Issue tabled until further info from county.e. Love Lake Draining area.   Lauthen and Ledermann met with county and city to receive proposal for installing 6 in. tile.  On a motion by Lanners, seconded by Lauthen, and carried. The agreement and Resolution # 04-18-2011 were approved.  (cf. attached)f. Board of Review minutes were approved on a motion by Lanners, seconded by Cleary and passed.g. A special town meeting will be scheduled for May 16, 2011 at 7 p.m. to recertify 2012 tax levy in order to qualify for gas tax refunds.  The new proposal will lower the general fund levy from $18,000 to $15,000 and raise the gas levy from $72,000 to $75,000, while keeping the total levy the same as previously certified.  Clerk will post the meeting for vote by all town voters.  Motion made by Lanners, seconded by Lauthen, and passed to schedule this meeting and submit the new proposal. (cf. attachment)h. Info on Douglas County per diems, salaries, etc. was shared.i. The Brandon Township  annual road inspection was set for April 25, 8:30 a.m. New Business: a. Gravel quotes:   Okerlund gravel quote of $7.50 per yard was approved on a motion by Lauthen, seconded by Lanners and carried.b. Swing Safe mail post info was shared.  Clerk will post info on the net.  Clerk will also draw up preliminary policy proposals for future consideration.c. Supervisor work contracts:  On a motion by Lanners, seconded by Cleary, and carried, work contracts for various maintenance tasks were approved for supervisors Lauthen and Cleary.d. DATA use of Brandon Township road right of ways was discussed.  No action taken.f.  Clerk notes were shared; no action taken.g. Ziegler Cat analysis has not been received; Lauthen will follow up. Claims and Wages:  Claims and wages requests were presented and viewed by the board.  Claims included:  The Record-$13.50 for legal notices; Viking Garage Door-$26.72 for door repair; Otter Tail Power-$31.92 for shop electricity; Gary's Auto Glass-$314.74 for grader glass; Ziegler Cat-$68.51 for parts; IRS-$605.14 for 1st Qt; PERA-$191.46 for 1st Qt.  Claims and Wages were ordered to be paid on a motion by Lanners seconded by Lauthen and approved. Next month meeting will be on Monday, May 16, 2011, 7p.m. at the Brandon Community Center.  This meeting will be preceded by a special town meeting beginning at 7 p.m. for the purpose of recertifying the 2012 town levy set on March 8, 2011.. The meeting was adjourned at 8:20 p.m.Adrian Ledermann, clerk                                     RESOLUTION # 01-18-2011-A COOPERATIVE AGREEMENT BETWEEN DOUGLAS COUNTY, CITY OF BRANDON AND BRANDON TOWNSHIP REGARDING LOVE LAKE DRAINAGE 

BE IT RESOLVED, that the proposed Cooperative agreement between the Douglas County, the City of Brandon and Brandon Township, a copy of which is attached hereto, is hereby approved, and

 

BE IT FURTHER RESOLVED, that the Chair of the Township Board of Supervisors and the Township Clerk are hereby authorized to sign said Agreement.

COOPERATIVE AGREEMENT BETWEEN DOUGLAS COUNTY, CITY OF BRANDON, AND BRANDON TOWNSHIP FOR INSTALLATION OF DRAINAGE TILE AT LOVES LAKE ON COUNTY STATE AID HIGHWAY NO. 82.

 

WHEREAS, Douglas County acting through the County Board of Commissioners, and

WHEREAS, the City of Brandon acting through the Brandon City Council,

WHEREAS, Brandon Township acting through the Township Board of Supervisors, and

WHEREAS, it is desired by all three entities to provide an outlet for Loves Lake to alleviate flooding caused by the unusually high water, and

WHEREAS, Douglas County will perform the work necessary to administer, design, develop specifications and construct or cause to be constructed all work, which will be used for the construction of a 6" tile outlet from Loves Lake to Long Lake under CSAH 82 and the Mn/DOT Rail Bank property.

 

NOW THEREFORE, BE IT AGREED, By and between Douglas County, the City of Brandon and Brandon Township that:

1. Douglas County shall design and prepare plans, acquire easements and permits, and provide construction inspection and documentation for the Construction Project.

2. The cost of the project will be shared by Douglas County, the City of Brandon and Brandon Township. (Estimated total cost is $30,000)

3. The City of Brandon's share of the project is $4,500, Brandon Township's share of the project is $4,500 and Douglas County will be responsible for the remainder of the costs.

4. Douglas County will bill the City of Brandon and Brandon Township for their share of the project once the County Board authorizes to proceed.

5. The City of Brandon and Brandon Township will reimburse Douglas County within 40 days of receipt of a billing from Douglas County.

6. Douglas County will assume responsibility for the maintenance of the tile upon completion of the project.

RESOLUTIONS # 04-18-2011 B & CAUTHORIZING CONTRACT WITH INTERESTED OFFICER 

WHEREAS, Town Board of Brandon Township, Douglas County, Minnesota is seeking the performance or acquisition of the following service or goods;

      * Various maintenance jobs

 

WHEREAS, Paul Lauthen is a supervisor of said Township and will be financially interested in the contract for the following described reason:

      * He is directly providing the service as an employee of the Township.

 

NOW, THEREFORE, BE IT RESOLVED that the Town Board, upon a unanimous vote of the supervisors with the interested officer ab staining, finds that the contract price of $15.00 is as low as, or lower than, the price at which the services or goods could be obtained elsewhere at this time; and

 

BE IT FURTHER RESOLVED,     that the Town Board, pursuant to MN Stat. P. 365.37; 471.88, subd. 5; and 471.89, does hereby authorize a contract with Paul Lauthen for a price of $15.00; payment to occur on the contract as agreed and upon the filing of a proper affidavit by the interest officer.

BE IT FURTHER RESOLVED,     that the Town Board, pursuant to MN Stat. P. 365.37; 471.88, subd. 5; and 471.89, does hereby authorize a contract with Michael Cleary for a price of $15.00; payment to occur on the contract as agreed and upon the filing of a proper affidavit by the interest officer.

 Proposed change to Brandon Township 2012 levy 

Whereas Brandon Township at its annual levy did not levy the required .04835 % of 2011 total market value of  Brandon Township properties valued at $153,370,800 required by state law in order to receive the gas tax refund, a special town meeting will be required to certify a change in the 2012 levy approved on March 8, 2011.   Below is the approved 2012 levy, along with the new proposed levy fulfilling the required levy of $74,155 needed for the road and bridge fund.  The new certification must by filed by September 15, 2011.  A special Town Meeting must be called to approve this new levy.
